ACC appeals sec. 404 permit to U.S. Court of Appeals

In early January, attorneys for the Airport Communities Coalition (ACC) filed a notice of appeal to the U.S. Court of Appeals for the Ninth Circuit from the decision by U.S. District Judge Barbara Rothstein upholding the wetlands-filling permit previously issued for the Sea-Tac third-runway project by the U.S. Army Corps of Engineers.

Judge Rothstein had previously denied a motion for reconsideration of her ruling favorable to the Engineers and the Port of Seattle.

To perfect the appeal, the ACC lawyers must prepare & file written legal arguments (briefs) and a record – the documents relevant to the case. Fortunately, the record is on CDs & may be filed with the appeals court in that convenient & inexpensive format.
